Misdemeanors
Misdemeanors are less serious than felonies. Misdemeanors can result in a jail sentence that does not exceed a year. If a jail sentence is imposed, it is served in a local, city or county jail rather than a state or federal prison (penitentiary).
The prosecutor does not usually require a grand jury to investigate and charge misdemeanors. However, misdemeanor charges can be generated by grand jury indictments if they accompany one or more felonies. Misdemeanors not accompanied by felony charges are typically charged by written complaint or information. Unlike felonies, misdemeanors are usually handled by special courts with abbreviated procedures.
Although misdemeanors are various crimes that do not rise to the level of a felony and a misdemeanor carries less jail time than a felony, a misdemeanor should still be considered serious. You or your loved one cannot afford not to retain an aggressive criminal defense attorney because you have "only" been charged with a misdemeanor.
Bill realizes that a misdemeanor charge may often carry mandatory jail time coupled with a significant fine, and severe probation restrictions. Your employment, your family life and your social life could forever be affected by a "mere" misdemeanor. As an example, if you are convicted of a misdemeanor you may have to serve time in jail. How are you going to explain your absence to your boss or your family? Although, you may not have to serve time in jail, your probation restrictions may be severe enough to damage your career or future career opportunities. It may also mean you cannot have contact with certain people in your life. If you violate these court ordered restrictions, you could serve more time in jail and have additional restrictions imposed.
There are different levels of misdemeanors. Obviously, a higher level misdemeanor means the court can impose a higher jail sentence, and more severe probation and life restrictions. Even if you are charged with something you feel is insignificant, unimportant, or menial, such as retail theft, or a simple drug crime, you need aggressive criminal defense representation. Remember, a misdemeanor can be a serious matter that could change your life now and in the future.
